Mr. Berenson, the former White House associate counsel, said that in rare cases, the presidents' advisers may decide that an existing law violates the Constitution "by invading the president's executive powers as commander in chief."And therefore, can ignore the law.
I am pretty sure I know what the Founding Fathers would have thought of this argument, having gone to the trouble of ridding us of a king.
That does not give the President and automatic right to violate the Constitution. The Constitution is the basis for all actions in all three branches of the Government and can only be changed by agreement of the Government and the majority of the State governments. Somehow I don't see Bushco having the legs to make an actual Constitutional change.
